Paedophile wins £107,500 in compensation from children he abused:
The case has been called 'disgusting', 'utterly baseless' and 'the downfall of justice' but no judge has been able to overturn the ruling that 43 children abused by Stan Wilminstot are ordered to pay £2,500 each in compensatory damages to their abuser. One mother told us:
"On contacting the CICA to get compensation for my child's abuse they informed me that a crime had actually been committed. They suggested that I contact the police who later arrested the man responsible."
That seems to be the premise for the case. According to Mr Wilminstot each of the children he abused made a verbal agreement not to tell their parents about the abuse. His lawyers confirmed:
"Oral contracts in the UK are as binding as written ones. It is natural to assume that our client would not have abused the children if they had not agreed to keep their mouths shut."
The judge awarded the paedophile £2,500 from each child that made accusations of abuse against him. Law experts were stunned at the decision as each child was only aged 8-12 at the time the verbal agreement was made. Justifying his position on the matter, the judge in question released a statement saying:
"As the majority of these children were between 20-30 years old when they finally spoke out about the abuse, that suggested to me that from the age of eighteen, the legal age for entering contracts, they decided to uphold the oral contract they made with their abuser. Had they come forward earlier then the oral contract could not have been deemed as broken as they were too young to be held by it."
He went on to clarify that he did not consider the four figure fine to be an excessive penalty for breaking that contract as many of the abused children had received thousands of pounds in compensation for the abuse already:
"Had the defendants not profited as the result of breaking their oral agreement with their abuser my ruling may have been different."
